What does a family lawyer actually do for you?
If you're facing separation or divorce, the legal process can feel like a maze. Here's a plain-English guide to the key stages – so you know what to expect before you even pick up the phone.
Initial Consultation – Your first meeting with a family lawyer is about understanding your situation. We listen, explain your rights and options, and help you see a path forward. There's no obligation – just clarity.
Negotiation & Communication – Most family law matters don't end up in court disputes. The first step is usually negotiation – working with the other party (and their lawyer) to reach agreement on parenting arrangements, property, and finances. This saves time, cost, and stress for everyone involved.
Family Dispute Resolution (Mediation) – If direct negotiation stalls, both parties are generally required by law to attempt mediation before going to court. A neutral mediator helps facilitate agreement. This stage resolves the majority of family law matters.
Consent Orders – Once an agreement is reached – whether through negotiation or mediation – we can formalise it as Consent Orders, approved by the Family Court. These are legally binding and provide lasting certainty for both parties.
Court Proceedings – If agreement cannot be reached, the matter proceeds to court. A judge will hear both sides and make orders on parenting or property. This is the final stage and one we work hard to help you avoid where possible. Every family situation is different, and not every matter goes through all five stages. Our role is to guide you through whichever stages apply to you – with clarity, care, and your best interests at heart.
